DIVORCE PROCEEDINGS often take a long time to complete and in the meantime, the spouses suffer great stress, bitterness and anger. The children may be traumatised as a result, and the legal costs can be enormous - even if an agreement is reached before going to Court. I have seen this happen many times in my experience in practice as a divorce attorney.

MEDIATION is another way. I have had specialised training in Family Law Mediation and I know that it can often save families a great deal of money and emotional distress.

THE WAY MEDIATION WORKS is that both the husband and wife attend a number of sessions (usually between two and eight altogether)with the Mediator, who is completely neutral and does not side with either of the spouses. The Mediator helps them to:

AFTER THE MEDIATION PROCESS has been completed, each spouse is advised to have the agreement checked by his/her own attorney. The divorce can then be finalised as soon as the Summons is sent and a Court date has been set. On that date, only one of the spouses needs to go to Court and the agreement will be made a Court Order.

THE REASONS FOR CHOOSING MEDIATION ARE:

MEDIATION CAN BE CHOSEN before or during divorce proceedings - or even after a divorce if there are problems to be sorted out later on, such as maintenance or access to children.

 

MEDIATION WILL WORK ONLY IF BOTH SPOUSES ARE WILLING TO PARTICIPATE IN THE PROCESS.
